The Guwahati High Court has stated that the government holds complete authority to deport illegal Bangladeshi immigrants from Assam and that there are no legal hurdles preventing the deportation process. The court’s observation came while hearing a petition related to a case involving an individual declared as an illegal foreigner.
The case was filed by a woman named Rezia Khatun, whose husband had earlier been declared an illegal immigrant by a competent tribunal. Rezia approached the High Court seeking to challenge that order. However, the court dismissed her plea and upheld the earlier decision, stressing that the deportation of identified foreigners is essential for maintaining the integrity and security of the state.
In its remarks, the bench said that the illegal entry of Bangladeshi nationals into Assam has become a matter of growing concern. It observed that such infiltration is “increasingly dangerous” and is gradually changing the demographic composition of the state. The court warned that this silent and systematic infiltration could have serious social and cultural consequences for Assam in the long run.
The High Court also said that the government has sufficient powers under the law to identify, detain, and deport foreigners found to be residing illegally in the country. It stated that even if the Government of Bangladesh fails to cooperate, the Indian government still has the authority to take necessary steps to remove such individuals from Indian territory.
“There are no legal obstacles in the way of deportation. The government possesses ample powers to carry out this task,” the court said in its order.
